Packer Feeding Law Upheld

The U.S. 8th Circuit Court of Appeals has set aside the U.S. District Court's decision that Iowa's ban on packer feeding of swine is unconstitutional. The U.S. 8th Circuit Court of Appeals has set aside the U.S. District Court's decision that Iowa's ban on packer feeding of swine is unconstitutional.

The appeals court returned the case to the district court in Des Moines for further review of the amendments to the packer feeding ban passed by the Iowa legislature in 2003.

Iowa Pork Producers Association (IPPA), Iowa Farm Bureau and Iowa Farmer's Union were parties in the case.

Legal counsel Eldon McAfee of Des Moines argued the case for the IPPA. “The ruling by the court of appeals recognizes that in 2003, the Iowa legislature removed the portion of the law, the cooperative exception to the ban on packer feeding of swine, which was the focus of the district court's ruling of unconstitutionality.”
