The Oklahoma Pork Council has sued to stop enforcement of state rules that prevent some farmers from spreading manure on certain days or under certain conditions.
The council claims those rules, passed Oct. 8 on an “emergency basis,” are beyond statutory authority.
The rules state that farmers who have received three or more complaints by neighbors can't spread manure from lagoons onto land when the wind exceeds 20 mph., on a weekend or state-recognized holidays.
