Comment Period Extended on Water Rule

The Environmental Protection Agency (EPA) announced it is extending the comment period until Nov. 14 on the proposed Waters of the U.S. (WOTUS) rule, which would expand the agency’s jurisdiction over specific waterways under the Clean Water Act (CWA). Recently a group of 63 agriculture and business organizations called on the EPA to withdraw the proposed WOTUS rule because of recent EPA statements that “violate basic open-government requirement” under the Administrative Procedures Act. In September, the House of Representatives voted to prevent the EPA from implementing the proposed rule. Similar legislation has been introduced in the Senate.
