Rehearing in COOL Appeal

The American Meat Institute (AMI) and co-plaintiffs have filed a petition seeking a rehearing with the U.S. Court of Appeals for the District of Columbia Circuit as part of its appeal for a preliminary injunction to block implementation of the U.S. Department of Agriculture’s (USDA) final rule on country-of-origin labeling (COOL). The rehearing request focuses on the USDA’s Agriculture Marketing Service (AMS) authority that was not addressed by the earlier panel ruling. The petition argues that the AMS is overstepping its authority by addressing production practices in the COOL rule, specifically prohibiting commingling of meat products.
